Terms of use

Written plainly because people using PrivateCue may be under pressure. Start with what the product is, how it may be used and why the final decision remains yours.
Agreement to these terms
These terms govern your use of PrivateCue. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
You must be at least 16 years old, or the age of digital consent in your country if higher, and able to form a binding agreement. If you are using PrivateCue on behalf of another person — for example protecting a parent — you confirm you have their knowledge and permission where they are able to give it.
What PrivateCue is, and what it is not
PrivateCue compares text you provide against a library of documented fraud scripts and reports how closely the text matches them, which specific patterns were found, and what independent verification steps exist.
Specifically, PrivateCue is not: legal advice; financial or investment advice; a law-enforcement service; a background-check or consumer-reporting agency; a private-investigation service; a person-search or surveillance tool; a debt-recovery or fund-recovery service; or a guarantee that any fraud will be prevented, detected or reversed.
Acceptable use
You agree not to use PrivateCue:
- to investigate, surveil, monitor, profile or build a dossier on any identifiable person;
- to harass, intimidate, defame, threaten, stalk or coerce anyone, or to support doing so;
- in connection with any attempt to locate or identify a person without their knowledge;
- to analyse text you obtained by unauthorised access to an account, device or service;
- as a consumer report, or for any purpose covered by the US Fair Credit Reporting Act or equivalent law — including employment, tenant, credit or insurance screening;
- to publish or distribute a report in a way that identifies a private individual as a fraudster, criminal or scammer;
- by automated or bulk means, including scraping, scripted submission, or reselling output as a service;
- to circumvent plan limits, including by creating multiple accounts;
- to probe, attack, reverse-engineer for the purpose of defeating, or attempt unauthorised access to the service;
- for any unlawful purpose or in violation of any applicable law.
The distinction that matters: you may analyse a conversation you are a party to, in order to protect yourself or someone you are responsible for. You may not use this product as an instrument against a person. We enforce this, and we will suspend or terminate accounts that violate it without refund where the violation is serious.
No reliance; your own verification
Pattern analysis is fallible in both directions. It produces false positives — flagging honest people, including people who are simply intense, secretive for good reasons, poor at video calls, or in a hurry — and false negatives — passing conversations that are in fact fraudulent, particularly novel scripts that are not yet in the taxonomy.
You are responsible for your own decisions and for verifying anything that matters through an independent channel. Every report we produce tells you how to do this. Do not end a relationship, accuse a person, contact an employer, report someone to a platform, or transfer or withhold money on the basis of a PrivateCue score alone.
We publish accuracy figures when we have a labelled dataset sufficient to compute them honestly. Until then we do not claim an accuracy rate, and you should not assume one.
Your account
You are responsible for keeping your credentials confidential and for everything that happens under your account. Tell us immediately at support@privatecue.com if you believe your account has been accessed by anyone else.
We may suspend or terminate an account that violates these terms, that we reasonably believe is fraudulent, or that is being used in a way that harms other people. Where the violation is not serious we will normally warn first. Where it is — particularly surveillance, harassment or use against an identifiable person — we will not.
You may delete your account at any time from your dashboard. Deletion is immediate and permanent.
Plans, billing and refunds
The free plan provides a limited number of full analyses per rolling 30-day window. It is not truncated: if the result indicates danger you will see the complete report.
Paid plans renew automatically at the end of each billing period until cancelled. You can cancel from your dashboard in one action. Cancellation takes effect at the end of the period you have already paid for; we do not issue pro-rata refunds for partial periods except as required by law or under the guarantee below.
Family membership. A Family organiser may invite up to four other adults, for five accounts total. Every member uses a separate login and controls their own history. The organiser has no automatic right to see a member's analyses or reports. A member may explicitly share a metadata-only risk alert and may revoke it. Removing a member ends their Family access but does not delete their account or private history.
14-day guarantee. If you are not satisfied with a paid plan for any reason, email support@privatecue.com within 14 days of purchase and we will refund it in full. We will not ask you to justify it and we will not attempt to retain you.
Prices are shown in the currency displayed at checkout and may change. We will give at least 30 days' notice of a price increase affecting an existing subscription, and you may cancel before it takes effect. Taxes, where applicable, are in addition to displayed prices unless stated otherwise.
The Recovery Pack is free and always will be, and it opens without an account: the recovery window closes in hours, and a signup form or a price in front of it would cost people money they cannot get back. There is nothing to refund because there is nothing to pay. The 14-day guarantee above applies to paid subscriptions.
Your content and your licence to us
You retain all rights in the text you analyse. Because that text is processed locally in your browser and never transmitted to us, you grant us no licence to it and we acquire no rights in it. There is nothing for you to grant.
You grant us a limited licence to process the account data and usage metadata described in the Privacy Policy, for the purpose of providing the service.
Our intellectual property
The service, including the taxonomy of fraud scripts, the indicator library, the scoring methodology, the reasoning text, the report design, the software and the PrivateCue name and marks, is owned by us or licensed to us and is protected by copyright, trade-mark and other laws.
You may use reports for your own personal protection and may share a report with individuals who have a legitimate interest in your safety — a family member, an adviser, a bank, a lawyer, law enforcement. You may not republish the taxonomy, the indicator library or the reasoning text; resell or redistribute output as a product or service; or use our marks in a way that suggests endorsement. Journalists, researchers and non-profit fraud-support organisations: email us. We grant reuse licences readily and free of charge where the purpose is protecting people.
No warranty
The service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, error-free, or that any fraud will be detected or prevented.
We do not warrant that output is accurate, complete or applicable to your situation. Fraud techniques change faster than any taxonomy can, and a script we have never seen will not be in ours.
Limitation of liability
To the maximum extent permitted by law, neither we nor our directors, employees or affiliates will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost money, lost data, reputational harm, emotional distress, or the acts or omissions of any third party — including any person whose conversation you analysed, any fraudster, any bank, platform or law-enforcement body — arising out of your use of or inability to use the service.
Our total aggregate liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $100.
You accept that fraud losses can be very large and that no software can prevent them. Our role is to give you information earlier. The decision, and its consequences, remain yours.
Indemnity
You agree to indemnify and hold harmless PrivateCue from claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these terms, your violation of any law or third-party right, or — importantly — your publication or use of a PrivateCue report in a way that identifies or accuses an individual.
This indemnity does not apply where you used the service as intended and the claim arises from our own negligence, breach or misconduct.
Third-party services
Reports contain links to third parties: government reporting centres, regulators, law-enforcement agencies, banks and fraud-support organisations. We do not control those sites, are not responsible for their content or availability, and listing them is not an endorsement. Reporting contacts change; if a link in your report is dead, search for the organisation by name.
Suspension, termination and discontinuation
You may stop using the service and delete your account at any time. We may suspend or terminate access for breach of these terms or for conduct that harms others, as described above. We may also change or discontinue the service, or a feature of it, with reasonable notice where practicable. If we discontinue a paid plan you are subscribed to, we will refund the unused portion of your current period.
Privacy
Our Privacy Policy forms part of these terms. Read it — it explains what little we collect and, more importantly, what we have architected ourselves out of being able to collect.
General
Governing law. These terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-laws rules. Mandatory consumer-protection law in your country of residence continues to apply and takes precedence where it conflicts.
Disputes. Please email support@privatecue.com first. Most complaints are about something we can fix in a day, and we would rather fix it than litigate.
Severability. If any provision is held unenforceable, the remainder continues in effect and the unenforceable provision will be modified to the minimum extent needed to make it enforceable.
Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the service. No failure or delay in exercising a right waives it.
Assignment. You may not assign these terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets, with notice.
Changes. We may update these terms. Material changes take effect no earlier than 14 days after we post them, and we will notify active accounts by email. Continued use after that period means you accept the updated terms; if you do not accept them, delete your account before they take effect and we will refund any unused prepaid period.
